Thé company Domaine de Puychêne, Sas registered with the trade register of Narbonne under n° 811 629 377 located 85 route du Somail 11120 Saint- Nazaire D’aude, the « gîte» designates the property rent by the Owner and the « Tenant » means the persons/ members of the family who rent the gîte during a limited period of time to the Owner.
Article 1
Duration: The Tenant signing this contract for a specific length of time cannot in any way exercise a right to remain in the gîte at the end of the stay.
Article 2
Conclusion of the contract: Booking becomes effective when the Tenant has sent the Owner within a maximum deadline of 3 days, a deposit for 30% of the total amount of the rental (by credit card or by bank transfer ). If the Owner does not receive the payment within 3 days, the booking will not be effective and the Owner will be free to dispose of his gîte. The rental concluded between the Tenant and the Owner can in no case be used by other persons without the Owner’s preliminary written approval. Breach of this article may lead to the immediate termination of the rental and the total amount of the rental will be due to the Owner.
Article 3
Cancellation by the Tenant: All cancellations must be provided in writing to the Owner (letter, email) by the Tenant.
a) cancellation up to 30 days before arrival: the deposit is refundable
b) cancellation up to 15 days before arrival: the balance of the price is refundable but the deposit is not refundable
c) cancellation less than 15 days before arrival: the whole price is kept by the owner. d) if the Tenant does not show up within 24 hours of the date of arrival on the contract, this contract will be null and void and the Owner will be free to rent the lace to someone else. The whole price of the rental is not refundable and the total amount of the rental will be due by the Tenant if not already paid.
e) if the Tenant decides to shorten his stay the amount of the rental remains due to the Owner, and there will be no refund for the Tenant.
f) It is recommended to subscribe a cancellation cover insurance. Bank charges will be paid by the Tenant.
Article 4
Cancellation by the Owner: In the unlikely event of a significant change or cancellation of the booking by the Owner, the Owner will inform the Tenant as soon as possible.The Owner will return the total amount paid by the Tenant within 7 days.
Article 5
Payment: The balance of the price of the rental must be paid by credit card, by bank transfer at the latest one month before the date of arrival in the gîte. If the Owner does not receive the payment on time the booking will be null and void and the Owner will be free to dispose of his gîte.
Article 6
Arrival / Departure: The Tenant must arrive at the Domaine on the agreed day between 5:00 and 7:00 PM. In case of late or delayed arrival, the Tenant must inform the Owner as soon as possible. At the end of the stay the gîte will have to be free between 8:00 and 10:00 AM on the agreed day.
Article 7
Inventory: An inventory is carried out and signed both by the Tenant and the Owner or a representative on entering and leaving the gîte. This inventory is the only reference in the case of claims as to the state of the gîte. The cleanliness of the gîte when the Tenant enters will appear on the inventory. The cleaning of the accomodation is compulsory and must be paid by the Tenant on the date of arrival. The Owner reserves the right to make deductions from the security deposit for any extra cleaning, over the number of hours committed to departure cleaning, and to claim against the Tenant for any damages or loss, the cost of which exceeds the security deposit.
Article 8
Guarantee deposit: When the Tenant arrives, a guarantee deposit of 300 euros is requested by the Owner. After the final inventory, just before leaving, this deposit is fully refunded except in the case of damage(s). In the case of a departure before 8:00 AM on the agreed day rendering an inventory impossible, the guarantee deposit will be returned to the Tenant within about one week if the gîte is found in a good state. The Owner reserves the right to claim by any mean for any damages or loss made by the Tenant, the cost of which exceeds the security deposit.
Article 9
Use of the gîte: The Tenant must ensure the peaceful nature of the gîte and use it for its established purpose. At the end of his stay the Tenant will have to give the gîte back to the Owner in the same general order and with all goods and furniture in which it was found when he arrived. Should the Tenant has not in a correct and decent behaviour and disturbs the other Tenants, the Owner may use his absolute discretion to terminate the holiday of the Tenant. In this situation the tenant will be required to leave the gîte. No refunds will be made except the guarantee deposit if the general state of the gîte allows to do so. For the comfort of all the insides of the gites are non-smoking areas.
Article 10
Number of persons: The number of people accepted in the gîte is defined at the time of the booking and cannot be modified witout the prior consent of the Owner. If the number of persons in the gîte exceeds the capacity, the Owner has the right to refuse the extra persons and to terminate the rental without prior notice and without refund or compensation.
Article 11
Pets: For hygienic and security reasons pets are not allowed. If this condition is not respected the Owner may refuse the booking or terminate the rental without prior notice and without refund or compensation.
Article 12
Insurance: The Tenant must keep the property and all the furniture, fittings, facilities, equipment and grounds in the same state of repair and condition as at the commencement of the holidays and in the same state of cleanliness and general order in which it was found when he arrived. The Tenant will be responsible for the payment of any breakages, loss or damage to the property that he or his family or friends caused. He must have an insurance policy to cover these different risks. The Tenant must report to the Owner without delay any defects to the property or breakdown in the equipment, plant, machinery or appliance in the property and gardens and arrangements will be made for repair and/or replacement as soon as possible.
Article 13
Payment of charges : At the end of the stay, the Tenant will have to pay the charges not included in the rental price.
Article 14
Linen and pool towels : the rental of Linen (sheets, hand towels and dishclothes) is included in the rental price.The owner does not provide the Tenant with pool towels which can be rent separately. Linen can be changed during the stay at Tenant’s request and this will involve additional costs.
Article 15
Tourist tax : the tourist tax is not included in the rental price and is to be paid by the Tenant.
Article 16
Electricity : the rental price includes a package of consumption of electricity of 20 Kwh per day. If more electricity is used, for example with the heating of the accomodation then extra cost will be charged on the basis of 0,20 euro/Kwh.
Article 17
Swimming-pool : the swimming-pool is not open all year round. If the rental period is outside April to October, please check with the Owner that the pool is opened, filled and ready for use. The swimming-pool is opened between 9:00 AM and 8:00 PM. The pool is not watched and the Tenant will use it under his own responsability. The Tenant agrees to take full responsability for the safety of all members of his familiy and/or of his friends in and around the swimming-pool. Children must be supervised by an adult at all times. Running around the pool and diving are strictly forbidden. For hygienic and security reasons it is forbidden to bring food at the pool and no glass is to be taken or used in the pool and in the pool area. Should any glass fall into the pool the owner may need to empty, clean and refill the pool. This may take a number of day and the owner will be allowed to keep the security/damage deposit if the Tenant is responsible for this.
Article 18
Access : the Owner will be allowed to inspect the gîte prior to the departure of the Tenant. The Owner will also have the right to access the gîte during the stay to carry out maintenance of private garden.
Article 19
Sécurité et valeurs : Any valuable left at the gîte are left at Tenant’s own risk and the Owner is not responsible for any loss. Proper care must be taken by the Tenant against theft and burglary. It is essential and also the Tenant’s responsability to ensure that all doors, shutters, windows are closed and locked when leaving the gîte. No refund can be given if the Tenant decides to leave the gîte as a consequence of a theft or of a burglary.
Article 20
Parking : the Tenant may park one vehicle only in the Domaine. Therefore ay other vehicle including visitors vehicle(s) should be parked outside. Any valuable left in the car are left at Tenant’s own risk and the Owner is not responsible for any loss. Proper care must be taken by the Tenant against theft and burglary. It is essential and also the Tenant’s responsability to ensure that all doors and windows are closed and locked when leaving the car.
Article 21
Claims: Any dispute arising between the parties about the validity, the interpretation or the execution of this contract shall be submitted to the exclusive jurisdiction of the courts of Narbonne applying the French laws. Nevertheless the parties undertake to do everything to try to find an amicable solution before any court action.
